Oysa ki, karar sonras\u0131 arazinin m\u00fclkiyetinin yeniden kamuya ge\u00e7mesi gerekiyordu. <\/b><\/p>\n<p>Bodrum\u2019un en de\u011ferli b\u00f6lgesinde yer alan 678 bin metrekarelik araziyi \u00d6zelle\u015ftirme \u0130daresi\u2019nden sat\u0131n alan Cengiz \u0130n\u015faat, villa ve otel in\u015faat\u0131na ba\u015fl\u0131yor. Mehmet Cengiz, proje i\u00e7in Bulgari ile el s\u0131k\u0131\u015ft\u0131.<\/p>\n<p>S\u00d6ZC\u00dc\u2019n\u00fcn bu geli\u015fmeyi duyurmas\u0131n\u0131n ard\u0131ndan ya\u015fanan tart\u0131\u015fmalar \u00fczerine Cengiz \u0130n\u015faat\u2019tan konuya ili\u015fkin a\u00e7\u0131klama yap\u0131ld\u0131. Bas\u0131n a\u00e7\u0131klamas\u0131n\u0131n tam metni \u015f\u00f6yle:<\/p>\n<p><strong>OSMANLI TAPUSU SUNDULAR<\/strong><\/p>\n<p>1. \u015eirketimizin Cennet Koyunda sahip oldu\u011fu arazi Mu\u011fla \u0130li, Bodrum \u0130l\u00e7esi, G\u00f6lk\u00f6y, G\u00f6l Mahallesi 107 Ada 1 parselde (eski 423 parsel) kay\u0131tl\u0131 bulunan ta\u015f\u0131nmazd\u0131r. Bu ta\u015f\u0131nmaz, Maliye Hazinesi&#8217;ne aitken, 01.06.2010 tarih ve 2010\/31 say\u0131l\u0131 \u00d6zelle\u015ftirme Y\u00fcksek Kurulu karar\u0131 ile \u00f6zelle\u015ftirme kapsam ve program\u0131na al\u0131nm\u0131\u015ft\u0131r. \u00d6zelle\u015ftirme kapsam\u0131na al\u0131nma karar\u0131na kar\u015f\u0131 a\u00e7\u0131lan dava, Dan\u0131\u015ftay taraf\u0131ndan reddedilmi\u015ftir ve bu karar kesinle\u015fmi\u015ftir. Bodrumlu baz\u0131 vatanda\u015flar\u0131n \u00f6zelle\u015ftirme ihalesi \u00f6ncesinde Osmanl\u0131 tapusundan kaynakl\u0131 olarak arazide hak iddialar\u0131 olmu\u015f ise de Kadastro Mahkemesinde g\u00f6r\u00fclen bu dava, Hazine lehine kesinle\u015fmi\u015f ve arazi, bu dava sonucunda Hazine ad\u0131na tescil edilmi\u015ftir.<\/p>\n<p><strong>NE KADAR \u00d6DEND\u0130?<\/strong><\/p>\n<p>2. Parselin bulundu\u011fu alan, 1990&#8217;l\u0131 y\u0131llardan beri imar planlar\u0131nda turizm alan\u0131 olarak belirlenmi\u015f olup \u00d6zelle\u015ftirme \u0130daresi Ba\u015fkanl\u0131\u011f\u0131 da 2012 y\u0131l\u0131nda buna g\u00f6re yeni bir imar plan\u0131 haz\u0131rlam\u0131\u015ft\u0131r ve bu imar plan\u0131 halen y\u00fcr\u00fcrl\u00fcktedir. Bu imar plan\u0131 haz\u0131rland\u0131ktan sonra tescilli sit stat\u00fcleri ile birlikte ta\u015f\u0131nmaz\u0131n \u00f6zelle\u015ftirme ihalesi yap\u0131lm\u0131\u015f ve ta\u015f\u0131nmaza 277.000.000-TL (o d\u00f6nemki kur ile 152 milyon ABD Dolar\u0131) teklif veren Al\u0131c\u0131, ihaleyi kazanm\u0131\u015ft\u0131r. \u0130hale sonras\u0131nda Al\u0131c\u0131&#8217;n\u0131n sahip oldu\u011fu bir \u015firket olan Bodrumbir Turizm Yat\u0131r\u0131m A.\u015e. ile \u00d6zelle\u015ftirme \u0130daresi Ba\u015fkanl\u0131\u011f\u0131 aras\u0131nda Sat\u0131\u015f S\u00f6zle\u015fmesi imzalanm\u0131\u015ft\u0131r.<\/p>\n<p><strong>DANI\u015eTAY\u2019IN \u0130PTAL KARARI<\/strong><\/p>\n<p>3. \u0130hale i\u015fleminin iptali i\u00e7in Dan\u0131\u015ftay&#8217;da idari davalar a\u00e7\u0131lm\u0131\u015f ise de o d\u00f6nemde ta\u015f\u0131nmaz\u0131n tapudan devrini \u00f6nleyecek bir y\u00fcr\u00fctmenin durdurulmas\u0131 veya iptal karar\u0131 verilmemi\u015f ve Bodrumbir A.\u015e., ihale bedelini \u00f6deyerek ta\u015f\u0131nmaz\u0131n tapusunu devralm\u0131\u015ft\u0131r. Bodrumbir A.\u015e. daha sonra \u015eirketimiz Cengiz \u0130n\u015faat San. ve Tic. A.\u015e. taraf\u0131ndan devral\u0131nm\u0131\u015f ve ta\u015f\u0131nmaz\u0131n m\u00fclkiyeti bu \u015fekilde \u015eirketimize intikal etmi\u015ftir.<\/p>\n<p>4. Kamuoyunda son d\u00f6nemde yer alan payla\u015f\u0131mlar\u0131n aksine \u015fu anda bu konu hakk\u0131nda Dan\u0131\u015ftay&#8217;da devam eden herhangi bir dava bulunmamaktad\u0131r. \u00d6zelle\u015ftirme ihalesinin iptaline ili\u015fkin olarak ta\u015f\u0131nmaz\u0131n Al\u0131c\u0131&#8217;ya devrinden \u00e7ok sonra verilmi\u015f olan Dan\u0131\u015ftay karar\u0131, hukuken \u015eirketimizin parseldeki m\u00fclkiyet hakk\u0131n\u0131 etkilememektedir.<\/p>\n<p><strong>ARKEOLOJ\u0130K ALAN TARTI\u015eMALARI<\/strong><\/p>\n<p>5. Arazinin tapusunun \u015eirketimize devrinden sonra 2013 y\u0131l\u0131nda, arsa \u00fczerindeki olas\u0131 yap\u0131la\u015fma alan\u0131nda 157 ayr\u0131 noktada sondaj yap\u0131lm\u0131\u015f ve sondaj sonucunda; Bodrum Kaymakaml\u0131\u011f\u0131 Sualt\u0131 Arkeoloji M\u00fczesi M\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan araziyle ilgili 24.01.2014 tarihli bir rapor haz\u0131rlanm\u0131\u015ft\u0131r. Rapora g\u00f6re, sondaj yap\u0131lan bu 157 noktan\u0131n hi\u00e7birinde herhangi bir arkeolojik buluntuya rastlanmam\u0131\u015ft\u0131r. Bu raporda ayr\u0131ca sosyal medyada payla\u015f\u0131lan ve \u015eirketimizin parselinden \u00e7\u0131kt\u0131\u011f\u0131 iddia edilen buluntular\u0131n parselde ger\u00e7ekle\u015ftirilen bir sondaj ya da kaz\u0131da ortaya \u00e7\u0131kmad\u0131\u011f\u0131 kesin olarak tespit edilmi\u015ftir.<\/p>\n<p><strong>\u0130MAR DURUMU<\/strong><\/p>\n<p>6. Ayr\u0131ca parselin yap\u0131la\u015fmaya \u015fu anda a\u00e7\u0131ld\u0131\u011f\u0131 ve imar plan\u0131n\u0131n Mahkemece iptal edildi\u011fine ili\u015fkin iddialar ger\u00e7ek d\u0131\u015f\u0131d\u0131r. Nitekim yukar\u0131da bahsedildi\u011fi \u00fczere arazinin ge\u00e7erli imar plan\u0131, \u00f6zelle\u015ftirme ihalesinden \u00f6nce 2012&#8217;de yap\u0131lm\u0131\u015f olup kesinle\u015fmi\u015ftir ve halen y\u00fcr\u00fcrl\u00fcktedir. \u00d6zelle\u015ftirme ihalesinden sonra arazinin imar durumunda herhangi bir de\u011fi\u015fiklik yap\u0131lmam\u0131\u015ft\u0131r.<\/p>\n<p>7. Arazideki 1. derece arkeolojik sit alan\u0131 olarak tescilli olan k\u0131s\u0131m ayr\u0131 bir parsel olarak tapuya tescil edilmi\u015ftir. Kanun gere\u011fi bu 1. Derece arkeolojik sit alan\u0131nda herhangi bir yap\u0131la\u015fma zaten m\u00fcmk\u00fcn de\u011fildir. Bu sit alan\u0131 \u015eirketimizce ayn\u0131 \u015fekilde korunacakt\u0131r.<\/p>\n<p><strong>FOTO\u011eRAF \u0130T\u0130RAZI<\/strong><\/p>\n<p>8. Sosyal medyada yer alan ve ormanl\u0131k olarak g\u00f6r\u00fcnen Cennet Koyu foto\u011fraf\u0131, \u015eirketimizin parseline ait de\u011fildir. \u015eirketimizin parseli ormanl\u0131k alan olmay\u0131p ekteki foto\u011frafta da g\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere ta\u015fl\u0131k arazidir ve bu nedenle, parselde ger\u00e7ekle\u015fecek projede herhangi bir a\u011fa\u00e7 kesimi s\u00f6z konusu de\u011fildir. Sit stat\u00fclerine ve imar plan\u0131na uygun olarak ger\u00e7ekle\u015ftirilecek bu proje kapsam\u0131nda parsele 50.000 adet a\u011fa\u00e7 dikilecektir.
