Baz\u0131 durumlarda m\u00fclk sahipleri y\u00fcksek bedelle kiralayabilmek ya da mevcut kirac\u0131yla y\u00fcksek zaml\u0131 s\u00f6zle\u015fme yapabilmek i\u00e7in dan\u0131\u015f\u0131kl\u0131 sat\u0131\u015f yapmaktad\u0131r. A\u00e7\u0131lan dava say\u0131s\u0131nda bir art\u0131\u015f oldu mu?<\/strong><\/span><\/em><\/p>\n<p>Kirac\u0131 ve ev sahibi aras\u0131ndaki tahliye davalar\u0131nda\/kira tespit davalar\u0131nda ya da arabuluculuk g\u00f6r\u00fc\u015fmelerinde, son y\u0131llardaki en b\u00fcy\u00fck art\u0131\u015f\u0131n ya\u015fand\u0131\u011f\u0131n\u0131 g\u00f6rmekteyiz. Hukuk davalar\u0131n\u0131n yan\u0131s\u0131ra ceza dosyalar\u0131nda da art\u0131\u015f\u0131n yans\u0131malar\u0131n\u0131 g\u00f6rmekteyiz. Ev sahibinin dava a\u00e7ma hakk\u0131 elbette ki var ancak yasa h\u00fckm\u00fc mahkemeyi de ba\u011flad\u0131\u011f\u0131 i\u00e7in mahkemeler, y\u00fczde 25\u2019i e\u011fer kirac\u0131 vermeyi kabul etmi\u015f veya vermi\u015f ise a\u00e7\u0131lan tahliye\/kira tespit davalar\u0131n\u0131 reddedebilecektir.<\/p>\n<p><strong>\u201cANAYASA MAHKEMES\u0130\u2019NE BA\u015eVURAB\u0130L\u0130R\u201d<\/strong><\/p>\n<p><em><span><strong>4) Kiraya y\u00fczde 25\u2019in \u00fczerinde bir art\u0131\u015f yapmak kanunen m\u00fcmk\u00fcn m\u00fc?<\/strong><\/span><\/em><\/p>\n<p>Yeni d\u00fczenleme, 5 y\u0131l\u0131 dolduran kirac\u0131lar a\u00e7\u0131s\u0131ndan bak\u0131ld\u0131\u011f\u0131nda; mal sahipleri kira tespit davas\u0131 a\u00e7\u0131p y\u00fczde 25 limiti olmaks\u0131z\u0131n kira art\u0131\u015f\u0131 yapabileceklerdir. M\u00fclk sahipleri 10 y\u0131l\u0131n\u0131 dolduran kirac\u0131lar i\u00e7in de tahliye davalar\u0131 a\u00e7abilmektedir. Mahkemeler yasal d\u00fczenleme kar\u015f\u0131s\u0131nda kira art\u0131\u015f\u0131n\u0131\/tahliye talebini kabul etmeyebilir. Ancak genel ve \u00f6zel s\u0131n\u0131rlamalar\u0131n Anayasa\u2019n\u0131n s\u00f6z\u00fcne ve ruhuna uygun olmas\u0131 gerekmektedir.
