Odadan odaya ge\u00e7i\u015fin y\u00f6netmelikte yer almad\u0131\u011f\u0131na h\u00fckmeden mahkeme, m\u00fcteahhitlik firmas\u0131n\u0131n \u00c7ubuk&#8217;a faizi ile birlikte 195 bin lira \u00f6demesine karar verdi.<\/b><\/p>\n<p>Kahramanmara\u015f\u2019ta i\u015f insan\u0131 U\u011fur \u00c7ubuk, 2014 y\u0131l\u0131nda \u00e7ocuklu arkada\u015f\u0131 doktor A.C.\u2019nin ortak oldu\u011fu m\u00fcteahhitlik firmas\u0131n\u0131n Adana\u2019n\u0131n G\u00fcrselpa\u015fa Mahallesi\u2019nde yapaca\u011f\u0131 l\u00fcks rezidanstan br\u00fct 200 metrekare olan 2 daire almaya karar verdi.<\/p>\n<p>4+1 dairelere 560 bin lira \u00f6deyen \u00c7ubuk, in\u015faat s\u0131ras\u0131nda dairelerin hem k\u00fc\u00e7\u00fck hem de balkonun yatak odas\u0131na dahil edildi\u011fini g\u00f6rd\u00fc. S\u00f6zle\u015fmenin aksi in\u015faat nedeniyle \u00c7ubuk, paras\u0131n\u0131n iade edilmesini istedi ancak olumsuz cevap ald\u0131.<\/p>\n<p><strong>\u2018BALKONLAR KAPATILIP, RUHSATSIZ ODA YAPILDI\u2019<\/strong><\/p>\n<p>\u0130ki dairenin tabusunu ald\u0131ktan sonra U\u011fur \u00c7ubuk, m\u00fcteahhidin ay\u0131pl\u0131 \u00fcr\u00fcn satt\u0131\u011f\u0131n\u0131 iddia ederek Adana 2\u2019nci T\u00fcketici Mahkemesi\u2019nde dava a\u00e7t\u0131. Mahkemenin atad\u0131\u011f\u0131 bilirki\u015fi, inceleme yaparak rapor haz\u0131rlad\u0131.<\/p>\n<p>Buna g\u00f6re; dairelerin b\u00fcy\u00fckl\u00fc\u011f\u00fcn\u00fcn s\u00f6zle\u015fmede belirtilenin aksine br\u00fct 117,44 metrekare, net 76,59 metrekare oldu\u011fu, balkonlar\u0131n kapat\u0131larak ruhsata ayk\u0131r\u0131 \u015fekilde oda yap\u0131ld\u0131\u011f\u0131, odaya yatak odas\u0131ndan ge\u00e7ildi\u011fi, odalar\u0131n giri\u015f kap\u0131lar\u0131n\u0131n ba\u011f\u0131ms\u0131z olmas\u0131 gerekti\u011fi belirtildi.<\/p>\n<p>S\u00f6zle\u015fmede 4+1 olarak belirtilen dairelerin 3+1 oldu\u011funun vurguland\u0131\u011f\u0131 raporda; dairelerin ay\u0131pl\u0131 bulundu\u011fu aktar\u0131larak, her iki dairenin ay\u0131p bedelinin 135 bin 114 lira oldu\u011fu kaydedildi.<\/p>\n<p><strong>\u2018Y\u00d6NETMEL\u0130KTE ODADAN ODAYA GE\u00c7\u0130\u015e YOK\u2019<\/strong><\/p>\n<p>M\u00fcteahhit firma yetkilileri ise mahkemedeki savunmas\u0131nda; U\u011fur \u00c7ubuk\u2019un daireleri bizzat gezip g\u00f6rd\u00fckten sonra be\u011fenerek ald\u0131\u011f\u0131n\u0131, bu nedenle davan\u0131n reddedilmesini istedi. 2019\u2019da g\u00f6r\u00fclen dava sonunda mahkeme, yap\u0131 ruhsat\u0131na ayk\u0131r\u0131 yap\u0131lan oda i\u00e7in imar bar\u0131\u015f\u0131ndan faydalan\u0131ld\u0131\u011f\u0131na de\u011findi.<\/p>\n<p>Mahkeme; s\u00f6z konusu odaya yatak odas\u0131ndan ge\u00e7ildi\u011fini, imar plan\u0131nda bir odadan di\u011fer odaya ge\u00e7ilerek odalar\u0131n d\u00fczenlenmesine ait bir h\u00fckm\u00fcn olmad\u0131\u011f\u0131n\u0131, yatak odas\u0131ndaki balkonun kapat\u0131lmas\u0131 ile yap\u0131lan odan\u0131n ancak \u2018giyinme odas\u0131\u2019 olarak kullan\u0131labilece\u011fini, imar plan\u0131nda dairelerin mimari projesi haz\u0131rland\u0131\u011f\u0131 s\u0131rada odadan odaya ge\u00e7ecek \u015fekilde bir oda yap\u0131lmas\u0131n\u0131n y\u00f6netmelikte olmad\u0131\u011f\u0131n\u0131 belirtti.<\/p>\n<p>T\u00fcm gerek\u00e7eleri g\u00f6z \u00f6n\u00fcnde bulunduran mahkeme, m\u00fcteahhidin, bilirki\u015fi raporundaki bedeli faiziyle birlikte U\u011fur \u00c7ubuk\u2019a \u00f6demesine h\u00fckmetti. M\u00fcteahhit firma da karara itiraz ederek, dosyay\u0131 temyize g\u00f6nderdi. Yarg\u0131tay 3\u2019\u00fcnc\u00fc Hukuk Dairesi de bu y\u0131l\u0131n may\u0131s ay\u0131nda yerel mahkemenin karar\u0131n\u0131 onad\u0131. Onama sonras\u0131 firma, U\u011fur \u00c7ubuk\u2019a faiziyle birlikte 195 bin lira \u00f6deme yapt\u0131.<\/p>\n<p><strong>\u2018BR\u00dcT\u00dcN \u0130\u00c7ER\u0130S\u0130NE \u0130ST\u0130NAT DUVARINI DA KATMI\u015e\u2019<\/strong><\/p>\n<p>\u00c7ocukluk arkada\u015f\u0131 taraf\u0131ndan kand\u0131r\u0131ld\u0131\u011f\u0131n\u0131 belirten U\u011fur \u00c7ubuk, bu durumun zoruna gitti\u011fini, bu nedenle dava a\u00e7t\u0131\u011f\u0131n\u0131 s\u00f6yledi. Mahkeme karar\u0131yla kar\u015f\u0131 taraftan 195 bin lira ald\u0131\u011f\u0131n\u0131 kaydeden \u00c7ubuk,<\/p>\n<p>\u201cBu evi topraktan ald\u0131m ve temeli hen\u00fcz at\u0131lmam\u0131\u015ft\u0131. \u0130nternet sitesinde, bro\u015f\u00fcrlerde l\u00fcks bir rezidans gibi g\u00f6z\u00fck\u00fcyordu. \u00c7ocukluk arkada\u015f\u0131mdan ald\u0131m. Kahramanmara\u015f\u2019ta ya\u015f\u0131yorum, i\u015f yerim de orada. Kendisi de br\u00fct\u00fcn i\u00e7erisinde otopark, havuz ve istinat duvar\u0131n\u0131n da oldu\u011funu s\u00f6yledi.<\/p>\n<p>Bunun m\u00fcmk\u00fcn olmayaca\u011f\u0131n\u0131 s\u00f6yleyince kendisi de \u2018Git mahkemeye ver, hakk\u0131n\u0131 ara. Mahkeme ne derse kabul\u00fcm\u2019 dedi. Dava a\u00e7t\u0131m, mahkeme s\u00fcrecinde bilirki\u015fi incelemeleri yap\u0131ld\u0131 ve itiraz da Yarg\u0131tay taraf\u0131ndan onand\u0131. Bundan sonra her m\u00fcteahhit reklamlar\u0131nda, bro\u015f\u00fcrlerinde ve s\u00f6zle\u015fmede ne yaz\u0131yorsa; onu verecek\u201d diye konu\u015ftu.<\/p>\n<p><strong>\u2018KES\u0130NL\u0130KLE S\u00d6ZLE\u015eMEYE G\u00d6RE HAREKET ED\u0130LMEL\u0130\u2019<\/strong><\/p>\n<p>U\u011fur \u00c7ubuk\u2019un avukat\u0131 B\u00fclent Marakl\u0131 ise mahkeme kararlar\u0131n\u0131n t\u00fcketici a\u00e7\u0131s\u0131ndan \u00e7ok \u00f6nemli oldu\u011funu s\u00f6yledi. Ev sat\u0131n alanlar\u0131n kesinlikle s\u00f6zle\u015fmeye g\u00f6re hareket etmesi gerekti\u011fini belirten Marakl\u0131, \u201cBilirki\u015fi incelemesi ve yarg\u0131lama s\u00fcrecinde ger\u00e7ekten de afi\u015flerde ve ilanlarda, sat\u0131\u015f reklamlar\u0131nda 200 metrekare ve 4+1 olarak taahh\u00fct edilen daire 76 metrekare net, 117 metrekare br\u00fct olarak \u00e7\u0131kt\u0131.<\/p>\n<p>Bu dosya, gerek ilk derece mahkemesi gerek istinaf gerekse de Yarg\u0131tay denetiminden ge\u00e7erek kesinle\u015fti ve m\u00fcvekkilimiz fazla \u00f6demi\u015f oldu\u011fu miktar\u0131n iadesine hak kazand\u0131. Yarg\u0131tay da m\u00fcteahhit firman\u0131n yapt\u0131\u011f\u0131 i\u015fin ay\u0131pl\u0131 oldu\u011funa karar verdi. As\u0131l \u00f6nemli olan \u015fey; bu dosyada ortaya \u00e7\u0131kan ve T\u00fcrkiye\u2019de bir\u00e7ok vatanda\u015f\u0131 ve t\u00fcketiciyi ilgilendiren temel durum\u201d dedi.<\/p>\n<p><strong>\u2018KARAR, GER\u00c7EKTEN EMSAL KARAR\u2019<\/strong><\/p>\n<p>Ruhsata ayk\u0131r\u0131 in\u015faata dikkat \u00e7eken Marakl\u0131, \u201cBalkon olarak yap\u0131lan eklentilerin daha sonra kapat\u0131larak, ayr\u0131 ve ba\u011f\u0131ms\u0131z bir oda olarak g\u00f6sterilmesi ve yine mimari proje ile yap\u0131 ruhsat\u0131nda yer almayan yerlerin kapal\u0131 alana dahil edilerek, sanki in\u015faat metrekaresi alan\u0131 gibi sat\u0131lmas\u0131n\u0131n ay\u0131pl\u0131 ve hileli oldu\u011funa karar verildi.<\/p>\n<p>\u00d6zellikle ilk derece mahkemesi, istinaf ve Yarg\u0131tay\u2019\u0131n bu karar\u0131, ger\u00e7ekten emsal bir karar. Yarg\u0131tay, ay\u0131pl\u0131 ve hatal\u0131 imalat\u0131n bu anlamda \u00f6zellikle afi\u015flerde, ilanlarda ve internet ortam\u0131nda taahh\u00fct edilen metrekare br\u00fct\u00fc ve net alanlar\u0131n proje ve ruhsata uygun olarak teslim edilmemesinin ay\u0131p oldu\u011funa karar vermi\u015ftir\u201d diye konu\u015ftu.
